Minnesota Provisional License Process

In Minnesota, the provisional license is a critical step in the Graduated Driver Licensing (GDL) system for teen drivers. It serves as an intermediate phase between a learner’s permit and a full driver’s license. This stage is designed to help young drivers gain experience under limited driving privileges before becoming fully licensed.

Eligibility for a Provisional License

To qualify for a provisional license in Minnesota, applicants must:

  • Be at least 16 years old.
  • Have held an instruction permit for at least six months with no moving violations or alcohol/substance-related offenses.
  • Complete at least 50 hours of supervised driving (15 of which must be at night), documented and signed by a parent or guardian.
  • Successfully complete an approved driver’s education program, including classroom and behind-the-wheel instruction.
  • Pass the road test administered by the Minnesota DVS.

Provisional License Restrictions

While holding a provisional license, teen drivers must follow specific restrictions:

  • Passenger Limitations: During the first six months, only one passenger under age 20 is allowed (excluding family members). For the next six months, up to three passengers under age 20 are permitted.
  • Nighttime Driving: Driving is prohibited from midnight to 5 a.m. during the first six months unless:
    • Accompanied by a licensed driver age 25 or older.
    • Driving to/from employment, a school event, or a home event (with documentation).
  • Cell Phone Use: Absolutely no use of cell phones or electronic devices, even hands-free.
  • Seat Belts: All passengers must wear seat belts at all times.

Advancing to a Full License

After maintaining a provisional license for 12 consecutive months without any traffic convictions, alcohol or controlled substance violations, and at least 18 years of age (if not advancing under GDL), a driver can apply for a full, unrestricted Class D license.

If under 18, applicants must:

  • Have a clean driving record for 12 months.
  • Pass the written knowledge test again if applying after their provisional license has expired.
  • Submit the application and pay applicable fees.
